Senate passes asbestos lawsuit bill

AUSTIN, Texas — Personal injury trial lawyers scored a rare victory in the Texas Senate with passage of legislation that would make it easier for some people to recover damages after being exposed to asbestos.

The bill, which passed 19-11 Monday, would only apply to lawsuits involving mesothelioma, a rare form of cancer usually caused by the inhalation of asbestos fibers.

The legislation, now moving to the Texas House, would set a lower standard of proof for demonstrating that asbestos exposure was significant enough to cause the cancer. Opponents won a minor concession with an amendment that allows defendants to present technical evidence about the level of exposure.
